SENATE BILL

                                     AN ACT

     1  Amending the act of July 31, 1963 (P.L.410, No.217), entitled
     2     "An act regulating and licensing all sales at retail when
     3     such sales are advertised as 'Closing Out Sale,' 'Fire, Smoke
     4     or Water Damage Sale,' or 'Defunct Business Sale,' with
     5     exceptions; requiring filing of inventory and bond; and
     6     providing for appeals and penalties," further providing for
     7     violations.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 13 of the act of July 31, 1963 (P.L.410,
    11  No.217), entitled "An act regulating and licensing all sales at
    12  retail when such sales are advertised as 'Closing Out Sale,'
    13  'Fire, Smoke or Water Damage Sale,' or 'Defunct Business Sale,'
    14  with exceptions; requiring filing of inventory and bond; and
    15  providing for appeals and penalties," is amended to read:
    16     Section 13.  Opening of [a Similar] Another Business.--
    17  Opening of [a] another business [similar to the one for which
    18  the sale, licensed pursuant to this act, was conducted, except
    19  the licensed "sale of goods damaged by fire, smoke or water,"]
    20  by the person, partnership, association, corporation, or partner

     1  of a partnership, officer of an association or principal
     2  stockholder of a corporation, who or which conducted the sale
     3  upon the same premises within one year of the termination of the
     4  sale, shall constitute a violation of this act. Every day in
     5  which business is conducted within the prohibited period of one
     6  year shall constitute a separate violation of this act.
     7     Section 2.  This act shall take effect in 60 days.
