SENATE BILL

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for the
     3     Pittsburgh Magistrates Court and the Traffic Court of
     4     Pittsburgh.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 1141 of Title 42 of the Pennsylvania
     8  Consolidated Statutes is amended to read:
     9  § 1141.  Pittsburgh Magistrates Court.
    10     [The Pittsburgh Magistrates Court shall be a court not of
    11  record and shall consist of such a number of judges, not less
    12  than five nor more than eight, as shall be specified by
    13  ordinance of the City of Pittsburgh. The magistrates court shall
    14  be the police magistrates authorized to be continued in
    15  existence by section 21, Schedule to Article V of the
    16  Constitution of Pennsylvania adopted April 23, 1968. Judges of
    17  the Pittsburgh Magistrates Court shall be deemed district
    18  justices for the purposes of Chapter 33 (relating to discipline,


     1  removal and retirement of judicial officers).] (a)  Abolition of
     2  court.--The Pittsburgh Magistrates Court as heretofore provided
     3  by this section is hereby abolished.
     4     (b)  Assignment of matters.--All causes and proceedings
     5  pending before any magistrate appointed pursuant to this section
     6  shall be transferred, determined and concluded by the district
     7  justice having jurisdiction of the cause or proceeding pursuant
     8  to the Pennsylvania Rules of Criminal Procedure and all books,
     9  dockets and records of any court or office abolished pursuant to
    10  this section shall become those of the district justice to
    11  which, under this section, jurisdiction of the cause or
    12  proceedings concerned has been transferred.
    13     Section 2.  Sections 1142 and 1143 of Title 42 are repealed.
    14     Section 3.  Section 1331 of Title 42 is amended to read:
    15  § 1331.  Traffic Court of Pittsburgh.
    16     [The Traffic Court of Pittsburgh shall be a court not of
    17  record and shall be held by such of the judges of the Pittsburgh
    18  Magistrates Court as shall be assigned thereto by the Mayor of
    19  the City of Pittsburgh, one of whom shall be designated by the
    20  mayor as the presiding magistrate of the traffic court. The
    21  court is established for the City of Pittsburgh.] (a)  Abolition
    22  of court.--The Pittsburgh Traffic Court as heretofore provided
    23  by this section is hereby abolished.
    24     (b)  Assignment of matters.--All causes and proceedings
    25  pending before any magistrate appointed pursuant to this section
    26  shall be transferred, determined and concluded by the district
    27  justice having jurisdiction of the cause or proceeding pursuant
    28  to the Pennsylvania Rules of Criminal Procedure and all books,
    29  dockets and records of any court or office abolished pursuant to
    30  this section shall become those of the district justice to

     1  which, under this section, jurisdiction of the cause or
     2  proceedings concerned has been transferred.
     3     Section 4.  Section 1332 of Title 42 is repealed.
     4     Section 5.  This act shall take effect January 1, 2002, or
     5  immediately, whichever is later.
