AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, further providing for the
3 number of judges of the courts of common pleas in certain
4 judicial districts AND FOR THE NUMBER OF JUDGES OF THE <--
5 PHILADELPHIA MUNICIPAL COURT AND THE PHILADELPHIA TRAFFIC
6 COURT.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 911(a) of Title 42 of the Pennsylvania <--
10 Consolidated Statutes is amended to read:
11 SECTION 1. SECTIONS 911(A), 1121 AND 1321 OF TITLE 42 OF THE <--
12 PENNSYLVANIA CONSOLIDATED STATUTES ARE AMENDED TO READ:
13 § 911. Courts of common pleas.
14 (a) General rule.--There shall be one court of common pleas
15 for each judicial district of this Commonwealth consisting of
16 the following number of judges:

5 § 1121. PHILADELPHIA MUNICIPAL COURT. <--
6 THE PHILADELPHIA MUNICIPAL COURT SHALL CONSIST OF [22] 25
7 JUDGES.
8 § 1321. TRAFFIC COURT OF PHILADELPHIA.
9 THE TRAFFIC COURT OF PHILADELPHIA SHALL BE A COURT NOT OF
10 RECORD AND SHALL CONSIST OF [SIX] SEVEN JUDGES. THE COURT IS
11 ESTABLISHED FOR THE CITY AND COUNTY OF PHILADELPHIA.
12 Section 2. (a) The provisions of 42 Pa.C.S. § 3135 shall
13 not be applicable to the selection of judges for the judgeships
14 created in the amendment of 42 Pa.C.S. § 911(a).
15 (b) Except as provided in subsections (c) and (d), the new
16 judgeships added by the amendment of 42 Pa.C.S. § 911(a) shall
17 be created on January 5, 1998, and shall be initially filled by
18 election at the 1997 municipal election.
19 (c) The new judgeships for the eighth, eleventh, twelfth, <--
20 TWENTY-THIRD, forty-third, FIFTIETH and fifty-seventh districts <--
21 added by the amendment of 42 Pa.C.S. § 911(a) shall be created
22 on January 3, 2000, and shall be initially filled by election at
23 the 1999 municipal election.
24 (d) The new judgeships for the second and fifteenth
25 districts added by the amendment of 42 Pa.C.S. § 911(a) shall be
26 created as follows: one judgeship in each district shall be
27 created on January 5, 1998, and shall be initially filled by
28 election at the 1997 municipal election and one judgeship in
29 each district shall be created on January 3, 2000, and shall be
30 initially filled by election at the 1999 municipal election.

1 Section 3. This act shall take effect immediately. <--
2 SECTION 3. THE FIRST JUDGES ELECTED TO THOSE JUDGESHIPS <--
3 CREATED UNDER 42 PA.C.S. §§ 1121 AND 1321 SHALL BE ELECTED AT
4 THE 1999 MUNICIPAL ELECTION.
5 SECTION 4. THIS ACT SHALL TAKE EFFECT AS FOLLOWS:
6 (1) THE AMENDMENT OF 42 PA.C.S. §§ 1121 AND 1321 SHALL
7 TAKE EFFECT ON THE FIRST MONDAY OF JANUARY 1998.
8 (2) THE REMAINDER OF THIS ACT SHALL TAKE EFFECT
9 IMMEDIATELY.
