AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, providing for sentencing
3 of certain persons who have committed a violation of The
4 Controlled Substance, Drug, Device and Cosmetic Act.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Title 42 of the Pennsylvania Consolidated
8 Statutes is amended by adding a section to read:
9 § 9720.2. Sentences for certain drug violations.
10 A person who is convicted of an offense which is graded as a
11 felony under the act of April 14, 1972 (P.L.233, No.64), known
12 as The Controlled Substance, Drug, Device and Cosmetic Act, may
13 be sentenced to a term of imprisonment for up to five years in
14 addition to the sentence provided for in the sentencing
15 guidelines for the violation itself where the offender is not a
16 resident of the county where the prosecution occurs.
17 Section 2. This act shall take effect in 60 days.
