           LEMMOND, BELL, KUKOVICH, SCHWARTZ, HOLL, COSTA, MELLOW,
           STOUT, WAGNER, DENT, CORMAN, LAVALLE, GREENLEAF, BOSCOLA,
           BODACK, O'PAKE, TARTAGLIONE, LOGAN, PUNT, JUBELIRER AND

        REFERRED TO FINANCE, JANUARY 31, 2001

                                     AN ACT

     1  Amending Titles 24 (Education) and 71 (State Government) of the
     2     Pennsylvania Consolidated Statutes, providing for eligibility
     3     for special early retirement.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 24 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 8314.  Eligibility for limited special early retirement.
     9     Notwithstanding any provisions of this title to the contrary,
    10  for the period of July 1, 2001, to June 30, 2004, any member
    11  who:
    12         (1)  has credit for at least 30 eligibility points;
    13         (2)  terminates school service; and
    14         (3)  files an application for an annuity with an
    15     effective date of retirement not later than July 1, 2004,
    16  shall be eligible for limited special early retirement
    17  consisting of a maximum single life annuity calculated pursuant

     1  to section 8342 (relating to maximum single life annuity)
     2  without any reduction by virtue of an effective date of
     3  retirement which is under the superannuation age.
     4     Section 2.  Title 71 is amended by adding a section to read:
     5  § 5308.3.  Eligibility for limited special early retirement.
     6     Notwithstanding any provisions of this title to the contrary,
     7  for the period of July 1, 2001, to June 30, 2004, any member
     8  who:
     9         (1)  has credit for at least 30 eligibility points;
    10         (2)  terminates State service; and
    11         (3)  files an application for an annuity with an
    12     effective date of retirement not later than July 1, 2004,
    13  shall be eligible for limited special early retirement
    14  consisting of a maximum single life annuity calculated pursuant
    15  to section 5702 (relating to maximum single life annuity)
    16  without any reduction by virtue of an effective date of
    17  retirement which is under the superannuation age.
    18     Section 3.  This act shall take effect immediately.
