AN ACT
Amending Title 23 (Domestic Relations) of the Pennsylvania
Consolidated Statutes, in child protective services, further
providing for definitions.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 6303 of Title 23 of the Pennsylvania
Consolidated Statutes is amended by adding a subsection to read:
ยง 6303. Definitions.

(e) Prenatal drug use.--It shall be considered child abuse
if a child is born and exhibits symptoms of withdrawal as a
result of prenatal drug abuse or tests positive at birth for a
controlled substance as defined in section 2 of the act of April
14, 1972 (P.L.233, No.64), known as The Controlled Substance,
Drug, Device and Cosmetic Act, unless the symptoms are exhibited
or the child tests positive for a controlled substance as a
result of the mother's lawful intake of the drug or substance as
prescribed.

Section 2. This act shall take effect in 60 days.
