AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, further providing for
3 criminal prosecutions involving domestic violence.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 1726.2 of Title 42 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 1726.2. Criminal prosecutions involving domestic violence.

10 (c) Sentencing.--The Pennsylvania Commission on Sentencing,
11 pursuant to section 2154 (relating to adoption of guidelines for
12 sentencing), shall provide for a sentencing enhancement for an
13 offense under subsection (b) when the offense occurs in the
14 presence of a minor child of any of the parties to the offense.
15 Section 2. This act shall take effect in 60 days.
