                                     AN ACT

     1  Amending the act of November 6, 1987 (P.L.381, No.79), entitled
     2     "An act relating to the protection of the abused, neglected,
     3     exploited or abandoned elderly; establishing a uniform
     4     Statewide reporting and investigative system for suspected
     5     abuse, neglect, exploitation or abandonment of the elderly;
     6     providing protective services; providing for funding; and
     7     making repeals," providing for release of information
     8     relating to certain convictions and pleas.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  The act of November 6, 1987 (P.L.381, No.79),
    12  known as the Older Adults Protective Services Act, is amended by
    13  adding a section to read:
    14  Section 503.1.  Release of information relating to certain
    15                     convictions and pleas.
    16     (a)  General rule.--Following an investigation by the
    17  department, an administrative department or a law enforcement
    18  agency of a report of abuse inflicted upon an older adult and
    19  the conviction of the person investigated for any offense
    20  involving the abuse, or a plea of guilty or nolo contendere


     1  involving the abuse, the department shall make available to any
     2  facility, upon request, the person's name and photograph.
     3     (b)  Maintenance of information.--The department shall
     4  maintain a record of the information required by this section
     5  and shall periodically seek information from law enforcement
     6  officials and district attorneys in this Commonwealth to update
     7  the records, including the name and photograph of the persons
     8  identified in subsection (a). Law enforcement officials and
     9  district attorneys shall cooperate with the department and shall
    10  provide the information requested in a timely manner.
    11     Section 2.  This act shall take effect in 60 days.
