AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," providing partial State reimbursement 6 for local school districts for costs incurred for certain 7 programs of asbestos removal. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 2574 of the act of March 10, 1949 11 (P.L.30, No.14), known as the Public School Code of 1949, is 12 amended by adding a subsection to read: 13 Section 2574. Approved Reimbursable Rental for Leases 14 Hereafter Approved and Approved Reimbursable Sinking Fund 15 Charges on Indebtedness.--* * * 16 (g) (1) Each school district shall be entitled to receive 17 from the Commonwealth a reimbursement payment for an approved 18 program of asbestos removal subject to the conditions and 19 limitations set forth in clauses (2), (3) and (4).
1 (2) The amount of reimbursement shall be the lesser of: 2 (i) the total cost of the contract for asbestos removal in 3 the school district; or 4 (ii) the payment authorized under clause (3) or (3.1) of 5 subsection (c), dependent upon the date of the contract for such 6 asbestos removal. 7 (3) The reimbursement payment shall be made for contracts 8 entered into on or after January 1, 1977, and shall cover 9 programs for asbestos removal, asbestos enclosure and the costs 10 of increasing air testing during the contract period. Under no 11 circumstances shall any payment be made for asbestos 12 encapsulation. 13 (4) Guidelines for the approval of asbestos removal or 14 asbestos enclosure under this subsection shall include the 15 attainment of an air quality standard which is no less than the 16 standard recommended by the Center for Disease Control and the 17 National Institute for Occupational Safety and Health. 18 (5) The provisions of this subsection include area 19 vocational-technical schools. 20 Section 2.
