AN ACT
1 Amending the act of July 3, 1986 (P.L.388, No.84), entitled "An
2 act requiring public agencies to hold certain meetings and
3 hearings open to the public; and providing penalties,"
4 further defining "meeting."
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. The definition of "meeting" in section 3 of the
8 act of July 3, 1986 (P.L.388, No.84), known as the Sunshine Act,
9 is amended to read:
10 Section 3. Definitions.
11 The following words and phrases when used in this act shall
12 have the meanings given to them in this section unless the
13 context clearly indicates otherwise:

15 "Meeting." Any prearranged gathering of an agency which is
16 attended [or participated in] by a quorum of the members of an
17 agency held for the purpose of deliberating agency business or
18 taking official action. A meeting may not be conducted via
1 telephone or other electronic or telecommunications equipment
2 nor shall an individual member of an agency participate in an
3 agency meeting via telephone or other electronic or
4 telecommunications equipment. Nothing in this act shall be
5 construed to permit discussions of agency business by a quorum
6 of the members of an agency via telephone or other electronic or
7 telecommunications equipment.

9 Section 2. This act shall take effect in 60 days.
