AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," providing partial State reimbursement 6 for mobile classroom facilities. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 2574 of the act of March 10, 1949 10 (P.L.30, No.14), known as the Public School Code of 1949, is 11 amended by adding a subsection to read: 12 Section 2574. Approved Reimbursable Rental for Leases 13 Hereafter Approved and Approved Reimbursable Sinking Fund 14 Charges on Indebtedness.--* * * 15 (g) (1) For the lease rental for any mobile classroom and 16 subject to the limitations in clause (2), reimbursement shall be 17 the lesser of: 18 (i) the cost of purchasing the mobile classroom; or 19 (ii) the product of the rated pupil capacity as determined 20 by the Department of Education at the time the purchase is
1 approved and one thousand one hundred dollars ($1,100). 2 (2) The following restrictions and limitations shall apply 3 to any reimbursements under this subsection: 4 (i) The utilization of a mobile classroom shall not expand 5 the existing student capacity of permanent structures by more 6 than twenty per centum. 7 (ii) The mobile classroom shall be used solely for a 8 classroom during the period of reimbursement payments. 9 (iii) The term of the lease or lease-purchase agreement 10 shall not exceed five (5) years. 11 (iv) Reimbursement payments shall be made solely for the 12 mobile unit and not for any necessary hookups, walkways or other 13 construction or connections necessary for the effective 14 functioning of the mobile classroom. 15 Section 2.
