                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for protective equipment for
     3     motorcycle riders.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3525 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3525.  Protective equipment for motorcycle riders.
     9     (a)  Protective headgear.--Except as provided in subsection
    10  (d), no person shall operate or ride upon a motorcycle or a
    11  motor-driven cycle (other than a motorized pedalcycle) unless he
    12  is wearing protective headgear which complies with standards
    13  established by the department.
    14     (b)  Eye-protective devices.--[Except as provided in
    15  subsection (d), no] No person shall operate or ride upon a
    16  motorcycle (other than a motorized pedalcycle or a three-wheeled
    17  motorcycle equipped with an enclosed cab) unless he is wearing


     1  an eye-protective device of a type approved by the department.
     2     (c)  Approval of equipment.--The department may approve or
     3  disapprove protective headgear and eye-protective devices
     4  required under this section and may issue and enforce
     5  regulations establishing standards and specifications for the
     6  approval of the headgear and devices. The department shall
     7  publish lists of all protective headgear and eye-protective
     8  devices by name and type which have been approved.
     9     (d)  Exception.--The provisions of [subsections (a) and (b)]
    10  subsection (a) shall not apply to the following:
    11         (1)  The operator or any occupant of a three-wheeled
    12     motorcycle equipped with an enclosed cab.
    13         (2)  A person 21 years of age or older who has been
    14     licensed to operate a motorcycle for not less than two full
    15     calendar years.
    16         (3)  A person 21 years of age or older who has completed
    17     a motorcycle rider safety course approved by the department
    18     or the Motorcycle Safety Foundation.
    19         (4)  The passenger of a person exempt under this
    20     subsection, if the passenger is 21 years of age or older.
    21     Section 2.  This act shall take effect in 60 days.
