SENATE BILL

        INTRODUCED BY GERLACH, THOMPSON, SALVATORE, COSTA, ROBBINS,
           O'PAKE, HART, PUNT, STOUT, KITCHEN AND RHOADES,
           JANUARY 31, 1997

        REFERRED TO EDUCATION, JANUARY 31, 1997

                                     AN ACT

     1  Amending the act of January 18, 1952 (1951 P.L.2128, No.605),
     2     entitled "An act defining and providing for the licensing and
     3     regulation of private driver education or training schools;
     4     conferring powers and imposing duties on the Department of
     5     Public Instruction; and imposing penalties," further
     6     regulating mileage and age of driver training vehicles.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 4(3)(d) of the act of January 18, 1952
    10  (1951 P.L.2128, No.605), referred to as the Private Driver
    11  Education or Training School Act, amended November 29, 1990
    12  (P.L.573, No.146), is amended to read:
    13     Section 4.  The qualifications for licensure and the
    14  standards of licensure.

    16     (3)  Instructional Equipment and Materials.

    18     (d)  Every vehicle used for practical driver training shall
    19  be a recent model, not more than [five (5)] eight (8) years old


     1  or having not more than [fifty thousand (50,000)] eighty
     2  thousand (80,000) miles, whichever occurs later, with special
     3  equipment as follows: operable extra brake pedal, and in the
     4  case of vehicles equipped with standard transmission an operable
     5  extra clutch pedal, defroster and heater in working order, rear-
     6  view mirror placed on the inside of the car in the vicinity of
     7  the cowl, two (2) outside rear-view mirrors, one on each side of
     8  the vehicle, and cushions for the proper seating of the
     9  students.

    11     Section 2.  This act shall take effect in 60 days.
