AN ACT
1 Amending the act of December 23, 2002 (P.L.1982, No.229),
2 entitled "An act amending Title 75 (Vehicles) of the
3 Pennsylvania Consolidated Statutes, further providing for
4 definitions, for grounds for refusing registration and for
5 renewal of registration; providing for motor carrier
6 vehicles; further providing for operation following
7 suspension of registration and for suspension of
8 registration; providing for suspension of motor carrier
9 vehicle registration; further providing for suspension of
10 operating privilege, for schedule of convictions and points,
11 for occupational limited license, for duty of driver in
12 construction and maintenance areas, for special speed
13 limitations, for availability of benefits, for trucks and
14 truck tractors and for speed timing devices; providing for
15 accidents involving certain vehicles; further providing for
16 unlawful activities; providing for lighted head lamps in work
17 zones; further providing for restraint systems, for operation
18 of vehicle without official certificate of inspection and for
19 inspection by police or Commonwealth personnel; providing for
20 designation of highway safety corridors; further providing
21 for erection of traffic-control devices while working;
22 requiring certain traffic-control devices in highway work
23 zones; and requiring a study by the Legislative Budget and
24 Finance Committee," further providing for the effective date.
25 The General Assembly of the Commonwealth of Pennsylvania
26 hereby enacts as follows:
27 Section 1. Section 24 of the THE act of December 23, 2002 <--
28 (P.L.1982, No.229), entitled "An act amending Title 75
1 (Vehicles) of the Pennsylvania Consolidated Statutes, further 2 providing for definitions, for grounds for refusing registration 3 and for renewal of registration; providing for motor carrier 4 vehicles; further providing for operation following suspension 5 of registration and for suspension of registration; providing 6 for suspension of motor carrier vehicle registration; further 7 providing for suspension of operating privilege, for schedule of 8 convictions and points, for occupational limited license, for 9 duty of driver in construction and maintenance areas, for 10 special speed limitations, for availability of benefits, for 11 trucks and truck tractors and for speed timing devices; 12 providing for accidents involving certain vehicles; further 13 providing for unlawful activities; providing for lighted head 14 lamps in work zones; further providing for restraint systems, 15 for operation of vehicle without official certificate of 16 inspection and for inspection by police or Commonwealth 17 personnel; providing for designation of highway safety 18 corridors; further providing for erection of traffic-control 19 devices while working; requiring certain traffic-control devices 20 in highway work zones; and requiring a study by the Legislative 21 Budget and Finance Committee," is amended BY ADDING A SECTION to <-- 22 read: 23 SECTION 23.1. UPON APPROVAL OF GUIDELINES RELATING TO THE <-- 24 IMPLEMENTATION OF THE AMENDMENT OR ADDITION OF 75 PA.C.S. §§ 25 4309 AND 6123(B) AND (C), THE DEPARTMENT OF TRANSPORTATION SHALL 26 PUBLISH A NOTICE IN THE PENNSYLVANIA BULLETIN INDICATING SUCH 27 APPROVAL. 28 SECTION 2. SECTION 24 OF THE ACT IS AMENDED TO READ: 29 Section 24. This act shall take effect as follows: 30 (1) The following provisions shall take effect 20030S0274B0359 - 2 -
1 immediately: 2 (i) The addition of the definitions of "active work 3 zone" and "work zone" in 75 Pa.C.S. § 102. 4 (ii) The amendment of 75 Pa.C.S. § 1371(b). 5 (iii) Section 21 of this act. 6 (iv) Section 22 of this act. 7 (v) Section 23 of this act. 8 (vi) This section. 9 (1.1) The amendment of section 1712(1) shall take effect 10 December 3, 2002. 11 (2) The following provisions shall take effect in 60 12 days: 13 (i) The amendment of 75 Pa.C.S. § 1553(a) and 14 (d)(11). 15 (ii) The amendment of 75 Pa.C.S. § 1554(f). 16 (iii) The amendment of 75 Pa.C.S. § 3365(b). 17 (iv) The addition of 75 Pa.C.S. § 3756. 18 (v) The addition of 75 Pa.C.S. § 4309. <-- 19 (vi) The amendment of 75 Pa.C.S. § 4704(a) and (c). 20 [(vii) The amendment of 75 Pa.C.S. § 4581. 21 (viii)] (vii) The addition of 75 Pa.C.S. § 6123(b) 22 and (c). 23 [(ix)] (viii) The addition of 75 Pa.C.S. § 6123.1. 24 [(V) THE ADDITION OF 75 PA.C.S. § 4309. <-- 25 (VI)] (V) THE AMENDMENT OF 75 PA.C.S. § 4704(A) AND 26 (C). 27 [(VII) THE AMENDMENT OF 75 PA.C.S. § 4581. 28 (VIII) THE ADDITION OF 75 PA.C.S. § 6123(B) AND (C). 29 (IX)] (VI) THE ADDITION OF 75 PA.C.S. § 6123.1. 30 (2.1) The amendment of 75 Pa.C.S. § 4581 shall take 20030S0274B0359 - 3 -
1 effect August 15, 2003. 2 (2.2) THE AMENDMENT OR ADDITION OF 75 PA.C.S. §§ 4309 <-- 3 AND 6123(B) AND (C) SHALL TAKE EFFECT THREE MONTHS FOLLOWING 4 THE PUBLICATION OF NOTICE BY THE DEPARTMENT OF TRANSPORTATION 5 THAT GUIDELINES RELATING TO THE IMPLEMENTATION OF THE 6 AMENDMENT OR ADDITION OF 75 PA.C.S. §§ 4309 AND 6123(B) AND 7 (C) HAVE BEEN APPROVED. 8 (3) The remainder of this act shall take effect in six 9 months. 10 SECTION 3. THE INITIAL GUIDELINES RELATING TO IMPLEMENTATION <-- 11 OF THE AMENDMENT OF 75 PA.C.S. § 4581 BY SECTION 17 OF THE ACT 12 SHALL BE PUBLISHED NO LATER THAN 30 DAYS AFTER THE EFFECTIVE 13 DATE OF THIS SECTION. 14 SECTION 4. THIS ACT SHALL BE RETROACTIVE TO FEBRUARY 21, 15 2003. 16 Section 2 5. This act shall take effect immediately. <-- A29L75JAM/20030S0274B0359 - 4 -
