        INTRODUCED BY RHOADES, CORMAN, SLOCUM, STAPLETON, HELFRICK,
           BODACK, GERLACH, BELAN, WAGNER, TOMLINSON, WENGER, LAVALLE,
           COSTA, THOMPSON, KASUNIC, BELL, MELLOW, PUNT, MUSTO, O'PAKE,
           TILGHMAN, DENT, LEMMOND, FUMO, HART, WAUGH, BOSCOLA, WOZNIAK,

                                     AN ACT

     1  Amending the act of November 13, 1995 (P.L.604, No.61), entitled
     2     "An act establishing the State Fire Commissioner within the
     3     Pennsylvania Emergency Management Agency; transferring the
     4     Volunteer Loan Assistance Program and the State Fire Academy
     5     to the State Fire Commissioner; and making repeals,"
     6     providing for the Fire Equipment Loan System.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of November 13, 1995 (P.L.604, No.61),
    10  known as the State Fire Commissioner Act, is amended by adding a
    11  section to read:
    12  Section 5.1.  Fire Equipment Loan System.
    13     (a)  Fire Equipment Loan System.--The Fire Equipment Loan
    14  System is hereby established. It shall be the duty of the
    15  commissioner to periodically send a form to each volunteer fire
    16  company in this Commonwealth on which the volunteer fire company
    17  may list any surplus firefighting equipment that the volunteer
    18  fire company would be willing to enter into an interfire


     1  departmental equipment loan program.
     2     (b)  Listing of equipment.--Upon return of the forms, the
     3  commissioner shall compile a listing of the aforementioned
     4  equipment and make that listing available to all volunteer fire
     5  companies in this Commonwealth. The initial listing shall be
     6  compiled no later than one year after implementation of this
     7  section.
     8     (c)  Acquisition of equipment.--If a volunteer fire company
     9  is in need of any equipment contained in the commissioner's
    10  listing, it may acquire that equipment on a loan basis from the
    11  volunteer fire company where the equipment originated, upon a
    12  standard mutual written agreement between the two volunteer fire
    13  companies to be devised by the commissioner. The equipment shall
    14  remain the property of the volunteer fire company from which it
    15  was loaned. The recipient volunteer fire company shall be
    16  responsible for shipping and handling costs.
    17     Section 2.  This act shall take effect in 60 days.
