        REFERRED TO PUBLIC HEALTH AND WELFARE, JANUARY 31, 1997

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing that breastfeeding is not
     3     violative of law and for exceptions to certain offenses for
     4     breastfeeding.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 18 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  §  113.  Breastfeeding not violative of law.
    10     A woman is not guilty of any offense defined by the laws of
    11  this Commonwealth or its political subdivisions for
    12  breastfeeding in any location, public or private, where she is
    13  otherwise authorized to be.
    14     Section 2.  Sections 3126 and 3127 of Title 18 are amended by
    15  adding subsections to read:
    16  § 3126.  Indecent assault.

    18     (c)  Breastfeeding.--No woman shall be deemed to be in


     1  violation of this section for breastfeeding in any location,
     2  public or private, where she is otherwise authorized to be.
     3  § 3127.  Indecent exposure.

     5     (c)  Breastfeeding.--No woman shall be deemed to be in
     6  violation of this section for breastfeeding in any location,
     7  public or private, where she is otherwise authorized to be.
     8     Section 3.  Section 5901 of Title 18 is amended to read:
     9  § 5901.  Open lewdness.
    10     (a)  Offense defined.--A person commits a misdemeanor of the
    11  third degree if [he] that person does any lewd act which [he]
    12  that person knows is likely to be observed by others who would
    13  be affronted or alarmed.
    14     (b)  Breastfeeding.--No woman shall be deemed to be in
    15  violation of this section for breastfeeding in any location,
    16  public or private, where she is otherwise authorized to be.
    17     Section 4.  Section 6312 of Title 18 is amended by adding a
    18  subsection to read:
    19  § 6312.  Sexual abuse of children.

    21     (g)  Breastfeeding.--No woman shall be deemed to be in
    22  violation of this section for breastfeeding in any location,
    23  public or private, where she is otherwise authorized to be.
    24     Section 5.  This act shall take effect in 60 days.
