SENATE BILL

           BOSCOLA, SCHWARTZ, STOUT AND MURPHY, FEBRUARY 4, 1999

                                     AN ACT

     1  Amending Title 53 (Municipalities Generally) of the Pennsylvania
     2     Consolidated Statutes, authorizing the commission to make
     3     grants to certain municipalities for augmentation of their
     4     police forces.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1. Title 53 of the Pennsylvania Consolidated Statutes
     8  is amended by adding a section to read:
     9  § 2172.  Crime Containment Officer Program.--
    10     (a)  General rule.--The commission shall administer the Crime
    11  Containment Officer Fund established under 42 Pa.C.S. § 1725.1
    12  (relating to costs) and make grants from the fund for
    13  augmentation of a municipality's police force in accordance with
    14  this section.
    15     (b)  Qualification for grant funding.--The commission may
    16  make grants for augmentation of the police force to a
    17  municipality:
    18         (1)  determined to be financially distressed under the


     1     act of July 10, 1987 (P.L.246, No.47), known as the
     2     Municipalities Financial Recovery Act;
     3         (2)  located within an empowerment zone or enterprise
     4     community designated under section 13301 of the Omnibus
     5     Budget Reconciliation Act of 1993 (Public Law 103-66, 107
     6     Stat. 543); or
     7         (3)  which has part or all of a State-designated
     8     enterprise zone within the municipal boundaries;
     9  and that has a need for the grants as determined by crime
    10  statistics acceptable to the commission.
    11     (c)  Purpose of grants.--Grants shall be for the purpose of
    12  hiring additional full-time police officers. Grants shall be
    13  made for a three-year period and shall be sufficient to
    14  reimburse a municipality for 100% of the newly hired police
    15  officers' salaries and benefits in the first year, 75% of the
    16  officers' salaries and benefits in the second year and 50% of
    17  the officers' salaries and benefits in the third year.
    18     (d)  Other funds.--In addition to the moneys available in the
    19  Crime Containment Officer Fund, any appropriation for municipal
    20  police officer training that remains as part of the Municipal
    21  Police Officers Training Commission, prior to lapsing, shall be
    22  deposited in the Crime Containment Officer Fund beginning with
    23  the current fiscal year, for the purposes set forth in this
    24  section.
    25     (e)  Regulations.--The commission shall promulgate rules and
    26  regulations to implement and administer this section within 90
    27  days of the effective date of this section.
    28     Section 2.  This act shall take effect in 60 days.
