        INTRODUCED BY ROBBINS, MADIGAN, FUMO, ARMSTRONG, WOZNIAK, ORIE,
           MUSTO, REGOLA, KASUNIC, GREENLEAF, TARTAGLIONE, BRUBAKER,
           BOSCOLA, FOLMER, FONTANA, BROWNE, PIPPY, STACK AND
           WONDERLING, MARCH 12, 2007

        REFERRED TO TRANSPORTATION, MARCH 12, 2007

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, authorizing certain charitable organizations to
     3     solicit funds on highways.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3545 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 3545.  Pedestrians soliciting rides or business.
     9     (a)  Prohibition.--No person shall:
    10         (1)  Stand on a roadway for the purpose of soliciting a
    11     ride.
    12         (2)  [Stand] Except as provided in subsection (b), stand
    13     on a roadway for the purpose of soliciting employment,
    14     business or contributions from the occupant of any vehicle.
    15         (3)  Stand on or in proximity to a highway for the
    16     purpose of soliciting the watching or guarding of any vehicle
    17     while parked or about to be parked on a street or highway.


     1     (b)  Exception.--
     2         (1)  Subsection (a)(2) shall not apply to a solicitation
     3     under paragraph (2) by a bona fide, duly constituted
     4     organization of law enforcement personnel, firefighters or
     5     other persons who protect the public safety acting under this
     6     subsection.
     7         (2)  A solicitation may be conducted on behalf of an
     8     organization listed under paragraph (1) in accordance with
     9     the following:
    10             (i)  The solicitation shall only occur at a
    11         controlled-intersection approach which meets all of the
    12         following:
    13                 (A)  Has a stop sign or a traffic signal.
    14                 (B)  Is located on a two-lane roadway having a
    15             maximum speed limit of 35 miles per hour or less.
    16             (ii)  The entities authorized under paragraph (1)
    17         must obtain the written approval of the political
    18         subdivision where the solicitation occurs and, as
    19         necessary, the written approval of the department if
    20         Federal-aid system highways are involved. The political
    21         subdivision and the department may base their decisions
    22         regarding approval or disapproval on public safety or
    23         traffic operations issues. Approval may be revoked if
    24         concerns are raised due to unanticipated public safety or
    25         traffic operations events.
    26     Section 2.  This act shall take effect in 60 days.
