SENATE BILL

           RAFFERTY, CORMAN, WENGER, MOWERY, PUNT, WONDERLING, PICCOLA
           AND THOMPSON, MARCH 3, 2003

        REFERRED TO LABOR AND INDUSTRY, MARCH 3, 2003

                                     AN ACT

     1  Amending the act of August 15, 1961 (P.L.987, No.442), entitled
     2     "An act relating to public works contracts; providing for
     3     prevailing wages; imposing duties upon the Secretary of Labor
     4     and Industry; providing remedies, penalties and repealing
     5     existing laws," excluding political subdivisions from the
     6     act; authorizing optional prevailing wage ordinances; and
     7     making repeals.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 2(4) of the act of August 15, 1961
    11  (P.L.987, No.442), known as the Pennsylvania Prevailing Wage
    12  Act, is amended to read:
    13     Section 2.  Definitions.--As used in this act--

    15     (4)  "Public body" means the Commonwealth of Pennsylvania,
    16  [any of its political subdivisions,] any authority created by
    17  the General Assembly of the Commonwealth of Pennsylvania and any
    18  instrumentality or agency of the Commonwealth of Pennsylvania,
    19  but shall not include a political subdivision or any authority,
    20  agency or instrumentality created by one or more political

     1  subdivisions.

     3     Section 2.  The act is amended by adding a section to read:
     4     Section 13.1.  Local Option.--Notwithstanding any provision
     5  of this act, a political subdivision may elect, by ordinance or
     6  resolution, to place itself within the jurisdiction of this act.
     7     Section 3.  (a)  Section 752 of the act of March 10, 1949
     8  (P.L.30, No.14), known as the Public School Code of 1949, is
     9  repealed.
    10     (b)  All other acts and parts of acts are repealed insofar as
    11  they are inconsistent with this act.
    12     Section 4.  This act shall take effect in 60 days.
