| AN ACT |
| |
1 | Amending the act of April 9, 1929 (P.L.177, No.175), entitled |
2 | "An act providing for and reorganizing the conduct of the |
3 | executive and administrative work of the Commonwealth by the |
4 | Executive Department thereof and the administrative |
5 | departments, boards, commissions, and officers thereof, |
6 | including the boards of trustees of State Normal Schools, or |
7 | Teachers Colleges; abolishing, creating, reorganizing or |
8 | authorizing the reorganization of certain administrative |
9 | departments, boards, and commissions; defining the powers and |
10 | duties of the Governor and other executive and administrative |
11 | officers, and of the several administrative departments, |
12 | boards, commissions, and officers; fixing the salaries of the |
13 | Governor, Lieutenant Governor, and certain other executive |
14 | and administrative officers; providing for the appointment of |
15 | certain administrative officers, and of all deputies and |
16 | other assistants and employes in certain departments, boards, |
17 | and commissions; and prescribing the manner in which the |
18 | number and compensation of the deputies and all other |
19 | assistants and employes of certain departments, boards and |
20 | commissions shall be determined," in powers and duties of the |
21 | Department of Public Welfare and its departmental |
22 | administrative and advisory boards and commissions, providing |
23 | for eligibility for subsidized child day care. |
24 | The General Assembly of the Commonwealth of Pennsylvania |
25 | hereby enacts as follows: |
26 | Section 1. The act of April 9, 1929 (P.L.177, No.175), known |
27 | as The Administrative Code of 1929, is amended by adding a |
28 | section to read: |

1 | Section 2336. Eligibility for Subsidized Child Care.--(a) A |
2 | family that has at least one parent who is a Pennsylvania |
3 | National Guard member that has been ordered to active Federal or |
4 | State service shall be given a preference for placement in |
5 | subsidized child care available under 55 Pa. Code Pt. V Subpt. B |
6 | (relating to eligibility for services), if the family otherwise |
7 | qualifies for subsidized child care services under regulations |
8 | of the Department of Public Welfare. |
9 | (b) A family shall continue to receive subsidized child care |
10 | services after the Pennsylvania National Guard member has |
11 | returned from active Federal or State service for as long as the |
12 | family continues to meet eligibility requirements under |
13 | regulations of the Department of Public Welfare. |
14 | Section 2. When the Department of Public Welfare receives |
15 | Federal approval for any necessary State plan amendment to carry |
16 | out the provisions of section 2336 of the act, it shall transmit |
17 | notice of that fact to the Legislative Reference Bureau for |
18 | publication as a notice in the Pennsylvania Bulletin. |
19 | Section 3. The addition of section 2336 of the act shall |
20 | apply 60 days following publication in the Pennsylvania Bulletin |
21 | of the notice of Federal approval under section 2 of this act. |
22 | Section 4. This act shall take effect immediately. |
