AN ACT
1 Amending Title 62 (Procurement) of the Pennsylvania Consolidated
2 Statutes, further providing for jurisdiction of the Board of
3 Claims.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 1724(a) of Title 62 of the Pennsylvania
7 Consolidated Statutes, added December 3, 2002 (P.L.1147,
8 No.142), is amended to read:
9 § 1724. Jurisdiction.
10 (a) Exclusive jurisdiction.--The board shall have exclusive
11 jurisdiction to arbitrate claims arising from all of the
12 following:
13 (1) A contract entered into by a Commonwealth agency in
14 accordance with this part and filed with the board in
15 accordance with section 1712.1 (relating to contract
16 controversies).
17 (2) A written agreement executed by a Commonwealth
18 agency and the Office of Attorney General in which the
1 parties expressly agree to utilize the board to arbitrate
2 disputes arising from the agreement.
3 (3) Unless otherwise provided by law, a contract entered
4 into by a Commonwealth agency involving real property
5 interests in which the Commonwealth agency is the respondent.
6 (4) Property disputes between the Department of
7 Transportation and the Department of Conservation and Natural
8 Resources or between the Department of Transportation and the
9 Pennsylvania Game Commission when land is required for a
10 public project.
