AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, prohibiting dealing in traffic-control devices or
3 bridge parts as scrap.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 75 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 6128. Dealing in official traffic-control devices or bridge
9 parts as scrap.
10 (a) General rule.--A person commits a summary offense if he
11 purchases, sells or offers for sale as scrap an official
12 traffic-control device or an identifiable railing or other part
13 of a public bridge.
14 (b) Presumption.--An official traffic-control device or an
15 identifiable railing or other part of a public bridge found in
16 the place of business of a person who deals in scrap metal shall
17 be presumed to be offered for sale by the scrap metal dealer.
18 (c) Exception.--This section shall not apply to sales by or
1 to the Commonwealth or local authorities or their agents or
2 contractors or manufacturers or fabricators.
3 (d) Penalty.--A person who violates the provisions of this
4 section shall, upon conviction, be sentenced to pay a fine of
5 $100 for each official traffic-control device or an identifiable
6 piece of railing or other part of a public bridge he is
7 convicted of purchasing, selling or offering for sale.
8 Section 2. This act shall take effect in 60 days.
