AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, providing for a safe driver point system. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Title 75 of the Pennsylvania Consolidated 6 Statutes is amended by adding a section to read: 7 § 1539.1. Safe driver point system. 8 (a) Established.--A safe driver point system for drivers 9 licensed in this Commonwealth who maintain a driving record free 10 from any convictions under this title is hereby established and 11 shall be administered by the department. 12 (b) Assignment of safe driver points.--Upon the completion 13 of each calendar year, the department shall award one safe 14 driver point to each driver licensed in this Commonwealth who 15 maintained a driving record free from convictions under this 16 title. A driver may accumulate no more than three safe driver 17 points under this section. 18 (c) Assignment of points for violations.--The safe driver
1 points awarded under this section may be used to offset any 2 points assigned under section 1535 (relating to schedule of 3 convictions and points), except as follows: 4 (1) Points assigned for violations of this title that 5 involve damage to another's property, injury or death. 6 (2) Points assigned for violations of this title where a 7 conviction for any of the following arise from the same 8 incident: 9 (i) An offense under section 3718 (relating to minor 10 prohibited from operating with any alcohol in system). 11 (ii) Any offense under Subch. B of Ch. 37 (relating 12 to serious traffic offenses). 13 (iii) An offense under 18 Pa.C.S. (relating to 14 crimes and offenses). 15 (3) Points assigned for violations of this title in 16 which the number of points assigned exceed the maximum number 17 of safe driver points that may be accumulated under this 18 section. 19 (d) Effect on insurance policies.--When the application of 20 the safe driver point system to a subsequent conviction under 21 this title result in the assignment of no points for the 22 violation, an insurer may not increase premiums, impose any 23 surcharge or rate penalty or make any driver record point 24 assignment for automobile insurance, nor shall an insurer cancel 25 or refuse to renew an automobile insurance policy on account of 26 the violation. 27 Section 2.
