AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," providing reimbursement to 4 counties for child welfare services. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 709 of the act of June 13, 1967 (P.L.31, 8 No.21), known as the Public Welfare Code, added December 19, 9 1980 (P.L.1321, No.239), is amended to read: 10 Section 709. Reimbursement to Counties.--(a) [Reimbursement 11 for child welfare services made pursuant to section 704.1 shall 12 not exceed the State funds appropriated each fiscal year. 13 (b)] Commencing no later than July 1, 1981, and until June 14 30, 1990, the county institution districts or their successors 15 shall be reimbursed in accordance with their fiscal year plans 16 as approved by the department. 17 (a.1) Commencing no later than July 1, 1990, the county 18 institution districts or their successors shall be reimbursed on
1 a quarterly basis in accordance with their fiscal year plans as 2 negotiated with and approved by the department. 3 (b) The annual level of reimbursement shall be formulated by 4 calculating, with even weight, each county's percentage of the 5 households in this Commonwealth which are at or below one 6 hundred percent of the Federal poverty income level and the 7 percentage of the Commonwealth's population under eighteen years 8 of age who reside in each county. 9 (c) The department shall, by regulation, define allowable 10 costs for authorized child welfare services and shall not 11 approve for reimbursement plans in the aggregate whose costs are 12 in excess of [the amount appropriated by the General Assembly] 13 one hundred ten percent of the prior fiscal year's plan. 14 Legislative oversight shall be required in the form of an annual 15 report to the Legislature from the department indicating, but 16 not limited to, showing the amounts paid to each county for each 17 fiscal year, the source of funds, the timeliness of payments and 18 the extent to which funds were not available to meet allowable 19 and authorized costs. 20 Section 2.
