SENATE BILL

No. 382 Session of 1997


        INTRODUCED BY TILGHMAN, FEBRUARY 6, 1997

        AS AMENDED ON THIRD CONSIDERATION, NOVEMBER 17, 1997

                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," providing counties of
     5     the second class A with the power to make grants to
     6     townships, boroughs and nonprofit corporations ORGANIZATIONS   <--
     7     for parks, recreation areas, open space projects and such
     8     other outdoor projects and for historic and museum projects.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 2199.12 of the act of July 28, 1953
    12  (P.L.723, No.230), known as the Second Class County Code, is
    13  amended to read:
    14     Section 2199.12.  Appropriations to Municipalities for Parks,
    15  Recreation Areas, etc.--The board of commissioners of any county
    16  of the second class A may appropriate from county funds moneys
    17  for grants to assist boroughs or townships within the county as
    18  well as nonprofit corporations ORGANIZATIONS in the purchase      <--
    19  [or], acquisition, improvement, equipping or landscaping,
    20  including the planting of shrubs and shade trees, of lands [or],


     1  buildings [or both] and facilities, and in the case of buildings
     2  and facilities, demolition of such, for parks, recreation areas,
     3  open space projects and other such outdoor projects and for
     4  historic or museum projects. FOR THE PURPOSES OF THIS SECTION,    <--
     5  THE TERM "NONPROFIT ORGANIZATIONS" SHALL MEAN ENTITIES WHICH ARE
     6  TAX EXEMPT UNDER SECTION 501(A) OF THE INTERNAL REVENUE CODE OF
     7  1986, (PUBLIC LAW 99-514, 26 U.S.C. § 501(A)) AS AMENDED (OR ANY
     8  SUCCESSOR PROVISION THERETO); NOT OPERATED FOR PROFIT; AND
     9  ORGANIZED TO:
    10     (1)  PRESERVE OR CONSERVE OPEN SPACE, NATURAL RESOURCES OR
    11  NATURAL HABITATS;
    12     (2)  PROMOTE OUTDOOR RECREATION AND THE ACQUISITION AND
    13  DEVELOPMENT OF FACILITIES RELATED THERETO; OR
    14     (3)  PRESERVE SITES OF HISTORICAL SIGNIFICANCE.
    15     Section 2.  This act shall take effect immediately.
