AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further providing for penalties for exceeding
3 maximum weights.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 4945 of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 4945. Penalties for exceeding maximum weights.

10 (e) Indemnification and contribution prohibited.--No person
11 against whom liquidated damages are assessed by the department
12 under a contract with the department under the provisions of
13 this section shall seek or attempt to seek contribution from or
14 indemnification by any other person for the liquidated damages
15 or any portion of the assessed liquidated damages. Any person
16 who violates the provisions of this subsection shall be liable
17 for damages in an amount equal to twice the amount of the
18 liquidated damages.
1 Section 2. This act shall take effect in 60 days.
