        SENATE AMENDMENTS TO HOUSE AMENDMENTS, OCTOBER 19, 1999

                                     AN ACT

     1  Amending the act of December 5, 1980 (P.L.1107, No.190),
     2     entitled "An act fixing the fees to be received by the
     3     Philadelphia Municipal Court in civil actions," amending the   <--
     4     title; increasing the fee for initial service of process.;     <--
     5     and providing for the Philadelphia Municipal Court Security
     6     Account.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The title of the act of December 5, 1980           <--
    10  (P.L.1107, No.190), referred to as the Philadelphia Municipal
    11  Court Fee Law, is amended to read:
    12                               AN ACT
    13  Fixing the fees to be received by the Philadelphia Municipal
    14     Court in civil actions; and providing for the Philadelphia
    15     Municipal Court Security Account.
    16     Section 2.  Section 1(b) of the act, amended April 16, 1992
    17  (P.L.148, No.26), is amended to read:
    18     SECTION 1.  SECTION 1(B) OF THE ACT OF DECEMBER 5, 1980        <--
    19  (P.L.1107, NO.190), REFERRED TO AS THE PHILADELPHIA MUNICIPAL


     1  COURT FEE LAW, AMENDED APRIL 16, 1992 (P.L.148, NO.26), IS
     2  AMENDED TO READ:
     3     Section 1.  * * *
     4     (b)  The foregoing fee schedule does not cover any costs for
     5  services performed by the sheriff or other writ server. Service
     6  of initial process shall be [$15] $25 $27. All other fees of the  <--
     7  sheriff or other writ server shall be in accordance with the
     8  sheriff's fee bill applicable to Philadelphia County.
     9     * * *
    10     Section 3.  The act is amended by adding a section to read:    <--
    11     Section 1.1.  (a)  There is established within the General
    12  Fund a restricted receipt account to be known as the
    13  Philadelphia Municipal Court Security Account. All moneys
    14  deposited into the account shall be used only for the physical
    15  protection of all facilities and courtrooms operated by the
    16  Philadelphia Municipal Court.
    17     (b)  In addition to the court costs and filing fees
    18  authorized to be collected by statute, an additional fee of $5
    19  shall be charged and collected by the Philadelphia Municipal
    20  Court for the initiation of a legal proceeding for which a fee
    21  or cost is now authorized, except that in criminal and summary
    22  matters the fee shall be charged only when a conviction is
    23  obtained or a guilty plea is entered. The additional fee of $5
    24  shall be deposited into the Philadelphia Municipal Court
    25  Security Account.
    26     (c)  Beginning with the fiscal year 1999-2000, the General
    27  Assembly shall appropriate funds within the Philadelphia
    28  Municipal Court Security Account in accordance with an annual
    29  written expenditure plan submitted by the President Judge of the
    30  Philadelphia Municipal Court to the Administrative Office of

     1  Pennsylvania Courts which describes the manner in which funds
     2  shall be expended for the physical protection of all facilities
     3  and courtrooms operated by the Philadelphia Municipal Court.
     4     Section 4.  This act shall take effect as follows:
     5         (1)  The amendment of section 1(b) of the act and this
     6     section shall take effect immediately.
     7         (2)  The remainder of this act shall take effect in 60
     8     days.
     9     SECTION 2.  THIS ACT SHALL TAKE EFFECT IMMEDIATELY.            <--
