AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," providing for the definition of 6 "institution of higher education"; and further providing for 7 the definitions of "school" and "school age" and for 8 qualification and application. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. The definitions of "school" and "school age" in 12 section 2002-B of the act of March 10, 1949 (P.L.30, No.14), 13 known as the Public School Code of 1949, amended July 11, 2006 14 (P.L.1092, No.114), are amended and the section is amended by 15 adding a definition to read: 16 Section 2002-B. Definitions. 17 The following words and phrases when used in this article 18 shall have the meanings given to them in this section unless the 19 context clearly indicates otherwise: 20 * * *
1 "Institution of higher education." A postsecondary 2 institution in this Commonwealth which is authorized to award 3 degrees. 4 * * * 5 "School." A public or nonpublic pre-kindergarten, 6 kindergarten, elementary school or secondary school at which the 7 compulsory attendance requirements of the Commonwealth may be 8 met and which meets the applicable requirements of Title VI of 9 the Civil Rights Act of 1964 (Public Law 88-352, 78 Stat. 241). 10 The term includes a postsecondary institution of higher 11 education. 12 "School age." Children from the earliest admission age to a 13 school's pre-kindergarten or kindergarten program or, when no 14 pre-kindergarten or kindergarten program is provided, the 15 school's earliest admission age for beginners, until the end of 16 the school year the student attains 21 years of age or 17 graduation from high school, whichever occurs first. The term 18 includes students who attend a postsecondary institution of 19 higher education until the end of the school year in which the 20 student attains 23 years of age or graduates from the 21 postsecondary institution of higher education, whichever occurs 22 first. 23 Section 2. Section 2003-B(c) of the act, amended July 13, 24 2005 (P.L.226, No.46), is amended to read: 25 Section 2003-B. Qualification and application. 26 * * * 27 (c) Scholarship organizations and pre-kindergarten 28 scholarship organizations.--A scholarship organization or pre- 29 kindergarten scholarship organization must certify to the 30 department that the organization is eligible to participate in 20070S0410B0457 - 2 -
1 the program established under this article and must agree to
2 annually report the following information to the department by
3 December 1, 2005, and September 1 of each year thereafter:
4 (1) (i) The number of scholarships awarded during the
5 immediately preceding school year to eligible pre-
6 kindergarten students.
7 (ii) The total and average amounts of the
8 scholarships awarded during the immediately preceding
9 school year to eligible pre-kindergarten students.
10 (iii) The number of scholarships awarded during the
11 immediately preceding school year to eligible students in
12 grades K through 8.
13 (iv) The total and average amounts of the
14 scholarships awarded during the immediately preceding
15 school year to eligible students in grades K through 8.
16 (v) The number of scholarships awarded during the
17 immediately preceding school year to eligible students in
18 grades 9 through 12.
19 (vi) The total and average amounts of the
20 scholarships awarded during the immediately preceding
21 school year to eligible students in grades 9 through 12.
22 (vii) Where the scholarship organization or pre-
23 kindergarten scholarship organization collects
24 information on a county-by-county basis, the total number
25 and the total amount of scholarships awarded during the
26 immediately preceding school year to residents of each
27 county in which the scholarship organization or pre-
28 kindergarten scholarship organization awarded
29 scholarships.
30 (viii) The number of scholarships awarded during the

1 immediately preceding school year to eligible students in 2 postsecondary institutions of higher education. 3 (ix) The total and average amounts of the 4 scholarships awarded during the immediately preceding 5 school year to eligible students in postsecondary 6 institutions of higher education. 7 (2) The information required under paragraph (1) shall 8 be submitted on a form provided by the department. No later 9 than September 1, [2005] 2007, and May 1 of each year 10 thereafter, the department shall annually distribute such 11 sample forms, together with the forms on which the reports 12 are required to be made, to each listed scholarship 13 organization and pre-kindergarten scholarship organization. 14 (3) The department may not require any other information 15 to be provided by scholarship organizations or pre- 16 kindergarten scholarship organizations, except as expressly 17 authorized in this article. 18 * * * 19 Section 3.
