           BELAN, HART AND RHOADES, FEBRUARY 7, 1997

                                     AN ACT

     1  Amending Titles 23 (Domestic Relations) and 75 (Vehicles) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     willful failure to pay support orders; and further providing
     4     for revocation and suspension of drivers' licenses.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 4354 of Title 23 of the Pennsylvania
     8  Consolidated Statutes is amended by adding a subsection to read:
     9  § 4354.  Willful failure to pay support order.

    11     (d)  Driver's license notification.--When an individual is
    12  sentenced under this section, the court may notify the
    13  Department of Transportation.
    14     Section 2.  Section 1532(b) of Title 75 is amended by adding
    15  a paragraph to read:
    16  § 1532.  Revocation or suspension of operating privilege.

    18     (b)  Suspension.--


     1         * * *
     2         (3.1)  Upon receipt of a certified record of a driver's
     3     sentencing under 23 Pa.C.S. § 4354 (relating to willful
     4     failure to pay support order), the department shall suspend
     5     the operating privilege of the driver until the driver
     6     establishes compliance with the support order which is the
     7     basis of the sentencing. This paragraph does not apply to a
     8     commercial driver's license.
     9         * * *
    10     Section 3.  The addition of 23 Pa.C.S. § 4354(d) and 75
    11  Pa.C.S. 1532(b)(3.1) shall apply to sentences imposed on or
    12  after the effective date of this act.
    13     Section 4.  This act shall take effect in 60 days.
