           FEBRUARY 6, 1989

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, prohibiting the solicitation of owners of motor
     3     vehicles involved in accidents.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7313.  Solicitation of owners of vehicles involved in
     9             accidents prohibited.
    10     (a)  Removal of vehicle.--A person commits a misdemeanor of
    11  the third degree if, at the scene of an accident, he solicits
    12  the owner of a motor vehicle involved in the accident to remove
    13  the vehicle.
    14     (b)  Referral of repair work and towing.--A person commits a
    15  misdemeanor of the third degree if, at the scene of an accident,
    16  on behalf of a vehicle body repair shop or a tow truck operator
    17  and for a commission or anything of value, he solicits the owner
    18  of a motor vehicle involved in the accident and refers the


     1  repair work or towing to the vehicle body repair shop or tow
     2  truck operator.
     3     Section 2.  This act shall take effect in 60 days.
