SENATE BILL

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for the
     3     appointment of bail commissioners in judicial districts
     4     located in counties of the second class A.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 42 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 1515.1.  Bail commissioners.
    10     (a)  Appointment.--With approval of the Supreme Court, the
    11  president judge of a judicial district that comprises a county
    12  of the second class A shall have the power to appoint for a term
    13  of four years qualified attorneys to act as after-hours, on-call
    14  bail commissioners.
    15     (b)  Jurisdiction.--Bail commissioners appointed under this
    16  section shall have the same jurisdiction exercised by the
    17  district justices under section 1515(a)(4) (relating to
    18  jurisdiction and venue).


     1     (c)  Local court rules.--Except as otherwise provided under
     2  this section, local rules shall provide for the:
     3         (1)  Method by which bail commissioners shall be
     4     selected, appointed and removed.
     5         (2)  Compensation that bail commissioners shall receive
     6     for the performance of their duties.
     7         (3)  Training that bail commissioners must receive and
     8     the standards of conduct for bail commissioners.
     9         (4)  Rights, responsibilities and authority of bail
    10     commissioners.
    11         (5)  Procedure for appealing the decisions of bail
    12     commissioners.
    13     Section 2.  This act shall take effect July 1, 1999, or
    14  immediately, whichever is later.
