AN ACT 1 Requiring certain retail motor vehicle fuel stations to provide 2 fuel and basic services to persons with disabilities at the 3 self-service price; and imposing a penalty. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Short title. 7 This act shall be known and may be cited as the Fuel 8 Stations' Accommodations for Persons with Disabilities Act. 9 Section 2. Definitions. 10 The following words and phrases when used in this act shall 11 have the meanings given to them in this section unless the 12 context clearly indicates otherwise: 13 "Basic maintenance services." Checking the oil and automatic 14 transmission fluid levels in a motor vehicle and cleaning the 15 windshield and rear window of a motor vehicle. 16 "Full-service." A retail motor vehicle fuel station, or a 17 motor vehicle fuel pump, which offers attendant service to the 18 public for the dispensing of motor vehicle fuel into a motor
1 vehicle. 2 "Persons with disabilities." Persons who have been issued a 3 current special registration plate and special parking placard 4 under 75 Pa.C.S. § 1338 (relating to handicapped plate and 5 placard). 6 "Retail motor vehicle fuel station." A place of business 7 where motor vehicle fuel is sold and dispensed into the tanks of 8 motor vehicles, either by means of a self-service or full- 9 service pump. 10 "Self-service." A retail motor vehicle fuel station, or a 11 motor vehicle fuel pump, that offers motor vehicle fuel to the 12 public and where the fuel is dispensed into a motor vehicle by 13 persons other than the service station attendant. 14 Section 3. Fuel and basic maintenance services provided to 15 persons with disabilities. 16 A retail motor vehicle fuel station which offers motor 17 vehicle fuel to the public at both full-service and self-service 18 motor vehicle fuel pumps shall provide fuel and basic 19 maintenance services to persons with disabilities at the self- 20 service motor vehicle fuel pump at the posted self-service price 21 during all hours that the full-service motor vehicle fuel pumps 22 are in operation. 23 Section 4. Penalty. 24 A person who violates this act commits a summary offense and 25 shall, upon conviction, be sentenced to pay a fine of not less 26 than $100. 27 Section 5.
