                                     AN ACT

     1  Reenacting and amending section 19 of the act of August 22, 1953
     2     (P.L.1344, No.383), entitled "An act relating to marriage;
     3     and amending, revising, consolidating and changing the law
     4     relating thereto," further providing for fees.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 19 of the act of August 22, 1953
     8  (P.L.1344, No.383), known as The Marriage Law, amended December
     9  20, 1990 (P.L.1471, No.222), is reenacted and amended to read:
    10     Section 19.  Fees.--The fee to be charged by the clerk of the
    11  orphans' court in various counties for issuing a marriage
    12  license or declaration and for returns thereof to the Department
    13  of Health shall be thirteen dollars, two dollars and fifty cents
    14  of which shall be for the use of the clerk of the orphans' court
    15  of the county wherein such license is issued, and fifty cents
    16  for the use of the Commonwealth plus [ten] thirteen dollars,
    17  which shall be in addition to the cost of the marriage license,
    18  [to] ten dollars of which shall be forwarded to the Department


     1  of Public Welfare for use for victims of domestic violence in
     2  accordance with the provisions of section 2333 of the act of
     3  April 9, 1929 (P.L.177, No.175), known as "The Administrative
     4  Code of [1929."] 1929" and three dollars of which shall be
     5  forwarded to the Administrative Office of Pennsylvania Courts
     6  for deposit into the Domestic Violence Judicial Education Fund
     7  and for use in providing domestic violence education programs as
     8  provided in 42 Pa.C.S. § 1906 (relating to Domestic Violence
     9  Judicial Education Fund). In addition, the clerk shall make the
    10  usual charge for affidavits. All monies collected by the said
    11  clerk for the use of the Commonwealth shall, on or before the
    12  tenth day of the following month, be transmitted to the State
    13  Treasurer, to be placed in the General Fund for the use of the
    14  Commonwealth or the Domestic Violence Judicial Education Fund as
    15  provided by law. The Commonwealth shall certify that such monies
    16  will not be used to supplant Federal and State funds otherwise
    17  available for domestic violence services.
    18     Section 2.  This act shall take effect in 60 days.
