AN ACT 1 Amending Title 23 (Domestic Relations) of the Pennsylvania 2 Consolidated Statutes, further providing for information to 3 consumer reporting agency. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 4303 of Title 23 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 4303. Information to consumer reporting agency. 9 Information regarding the name and the amount of arrearages 10 owed by an obligor shall be provided periodically to consumer 11 reporting agencies whenever the obligor owes overdue support, 12 subject to the following: 13 (1) The information shall be available only after the 14 obligor owing the arrearages has been notified of the 15 proposed action and given a period not to exceed 20 days to 16 contest the accuracy of the information. The notice shall be 17 as provided by local rule of the court of common pleas. 18 (2) Such information shall not be made available to:
1 (i) a consumer reporting agency which the department 2 determines not to have sufficient capability to 3 systematically and timely make accurate use of such 4 information; or 5 (ii) an entity which has not furnished evidence 6 satisfactory to the department that the entity is a 7 consumer reporting agency. 8 (3) Such information shall not be made available if the 9 arrearage resulted from failure of the obligor's employer to 10 attach income as provided in section 4348 (relating to 11 attachment of income). 12 Section 2.
