SENATE BILL

           FEBRUARY 21, 1989

                                     AN ACT

     1  Amending Title 71 (State Government) of the Pennsylvania
     2     Consolidated Statutes, placing limitations on investments in
     3     companies doing business in or with Northern Ireland.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 71 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 5940.  Northern Ireland-related investments.
     9     (a)  General rule.--Notwithstanding any other provision of
    10  law, on and after the effective date of this section, any moneys
    11  or assets of the fund which shall remain or be invested in the
    12  stocks, securities or other obligations of any institution or
    13  company doing business in or with Northern Ireland, or with
    14  agencies or instrumentalities thereof, shall be invested subject
    15  to the provisions of subsection (c).
    16     (b)  Annual review.--On or before January 1 of each year, the
    17  board shall determine the existence of affirmative action taken
    18  by institutions or companies doing business in Northern Ireland

     1  to eliminate ethnic or religious discrimination based on actions
     2  taken for:
     3         (1)  Increasing the representation of individuals from
     4     underrepresented religious groups in the work force,
     5     including managerial, supervisory, administrative, clerical
     6     and technical jobs.
     7         (2)  Providing adequate security for the protection of
     8     minority employees both at the workplace and while traveling
     9     to and from work.
    10         (3)  The banning of provocative religious or political
    11     emblems from the workplace.
    12         (4)  Publicly advertising all job openings and making
    13     special recruitment efforts to attract applicants from
    14     underrepresented religious groups.
    15         (5)  Providing that layoff, recall and termination
    16     procedures should not in practice favor particular religious
    17     groupings.
    18         (6)  The abolition of job reservations, apprenticeship
    19     restrictions and differential employment criteria which
    20     discriminate on the basis of religion or ethnic origin.
    21         (7)  The development of training programs that will
    22     prepare substantial numbers of current minority employees for
    23     skilled jobs, including the expansion of existing programs
    24     and the creation of new programs to train, upgrade and
    25     improve the skills of minority employees.
    26         (8)  The establishment of procedures to assess, identify
    27     and actively recruit minority employees with potential for
    28     further advancement.
    29         (9)  The appointment of senior management staff members
    30     to oversee affirmative action efforts and the setting up of

     1     timetables to carry out affirmative action principles.
     2     (c)  Investments.--Consistent with sound investment policy,
     3  the board shall invest the assets of the fund in such a manner
     4  that the investments in institutions doing business in or with
     5  Northern Ireland shall reflect the advances made by such
     6  institutions in eliminating discrimination as established
     7  pursuant to subsection (b).
     8     Section 2.  This act shall take effect immediately.
