AN ACT 1 Amending the act of March 28, 1984 (P.L.150, No.28), entitled 2 "An act relating to the rights of purchasers of defective new 3 motor vehicles," further providing for the definition of "new 4 motor vehicle" and for repairs required. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The definition of "new motor vehicle" in section 8 2 of the act of March 28, 1984 (P.L.150, No.28), known as the 9 Automobile Lemon Law, is amended to read: 10 Section 2. Definitions. 11 The following words and phrases when used in this act shall 12 have the meanings given to them in this section unless the 13 context clearly indicates otherwise: 14 * * * 15 "New motor vehicle." Any new and unused self-propelled, 16 motorized conveyance driven upon public roads, streets or 17 highways which is designed to transport not more than 15 18 persons, which either was purchased [and] or is registered in
1 the Commonwealth and is used or bought for use primarily for
2 personal, family or household purposes, including a vehicle used
3 by a manufacturer or dealer as a demonstrator or dealer car
4 prior to its sale. The term does not include motorcycles, motor
5 homes or off-road vehicles.

7 Section 2. Section 4(a) of the act is amended to read:
8 Section 4. Repair obligations.
9 (a) Repairs required.--The manufacturer of a new motor
10 vehicle [sold and] which either was purchased or is registered
11 in the Commonwealth shall repair or correct, at no cost to the
12 purchaser, a nonconformity which substantially impairs the use,
13 value or safety of said motor vehicle which may occur within a
14 period of one year following the actual delivery of the vehicle
15 to the purchaser, within the first 12,000 miles of use or during
16 the term of the warranty, whichever may first occur.

18 Section 3. This act shall take effect in 60 days.
