AN ACT 1 Amending Title 62 (Procurement) of the Pennsylvania Consolidated 2 Statutes, further providing for powers and duties of the 3 Department of General Services. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 321 of Title 62 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 321. Powers and duties. 9 Except as otherwise specifically provided in this part, the 10 department shall have the following powers and duties: 11 (1) Procure or supervise the procurement of all 12 supplies, services and construction needed by executive 13 agencies and those independent agencies for which the 14 department acts as purchasing agency. Procurement authority 15 may be delegated in writing by the Secretary of General 16 Services. 17 (2) Exercise general supervision and control over all 18 inventories of supplies belonging to executive agencies.
1 (3) Sell, trade or otherwise dispose of surplus supplies 2 belonging to executive or independent agencies. 3 (4) Coordinate programs of executive and independent 4 agencies for the inspection, testing and acceptance of 5 supplies and construction to ensure availability of 6 facilities and to avoid a duplication of functions. 7 (5) Establish and maintain a central office where 8 businesses operating in this Commonwealth may obtain 9 information pertaining to the procurement needs of 10 Commonwealth agencies. 11 (6) Participate in the management and maintenance of a 12 contractor responsibility program in coordination with the 13 Office of the Budget and other agencies as may be directed by 14 the Governor. 15 (7) Insure that procurement of goods, supplies and 16 material for executive agencies and those independent 17 agencies for which the department acts as purchasing agency 18 are labeled Energy Star in compliance with the Environmental 19 Protection Agency and the Department of Energy specifications 20 whenever possible. 21 (8) Prior to approval to rent, purchase or renovate a 22 building or structure for executive agencies and those 23 independent agencies for which the department acts as an 24 agent, the department must consider if the building or 25 structure is energy efficient. The department may deny a 26 rental, purchase or renovation if the building is deemed not 27 to be energy efficient. 28 Section 2. This act shall take effect in 60 days.
