                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for restraint systems.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Section 4581(a)(2) of Title 75 of the
     6  Pennsylvania Consolidated Statutes is amended to read:
     7  § 4581.  Restraint systems.
     8     (a)  Occupant protection.--
     9         * * *
    10         (2)  [Except for children under eight years of age and
    11     except as provided in paragraphs (1) and (1.1), each] Each
    12     driver and front seat occupant eight years of age or older of
    13     a passenger car, Class I truck, Class II truck or motor home
    14     operated in this Commonwealth shall wear a properly adjusted
    15     and fastened safety seat belt system. A conviction under this
    16     paragraph by State or local law enforcement agencies shall
    17     occur only as a secondary action when a driver of a motor


     1     vehicle has been convicted of any other provision of this
     2     title. The driver of a passenger automobile shall secure or
     3     cause to be secured in a properly adjusted and fastened
     4     safety seat belt system any occupant who is eight years of
     5     age or older and less than 18 years of age. This paragraph
     6     shall not apply to:
     7             (i)  A driver or front seat occupant eight years of
     8         age or older of any vehicle manufactured before July 1,
     9         1966.
    10             (ii)  A driver or front seat occupant eight years of
    11         age or older who possesses a written verification from a
    12         physician that he is unable to wear a safety seat belt
    13         system for physical or medical reasons, or from a
    14         psychiatrist or other specialist qualified to make an
    15         informed judgment that he is unable to wear a safety seat
    16         belt system for psychological reasons.
    17             (iii)  A rural letter carrier while operating any
    18         motor vehicle during the performance of his duties as a
    19         United States postal service rural letter carrier only
    20         between the first and last delivery points.
    21             (iv)  A driver who makes frequent stops and is
    22         traveling less than 15 miles per hour for the purpose of
    23         delivering goods or services while in the performance of
    24         his duties and only between the first and last delivery
    25         points.
    26     A violation of this paragraph shall not be subject to the
    27     assessment of any points under section 1535 (relating to
    28     schedule of convictions and points).

    30     Section 2.  This act shall take effect in 60 days.
