| AN ACT |
| |
1 | Amending the act of June 23, 1931 (P.L.932, No.317), entitled |
2 | "An act relating to cities of the third class; and amending, |
3 | revising, and consolidating the law relating thereto," |
4 | further providing for qualifications for election of |
5 | councilmen, mayor, city treasurer and city controller. |
6 | The General Assembly of the Commonwealth of Pennsylvania |
7 | hereby enacts as follows: |
8 | Section 1. Sections 1001 and 1201 of the act of June 23, |
9 | 1931 (P.L.932, No.317), known as The Third Class City Code, |
10 | reenacted and amended June 28, 1951 (P.L.662, No.164) and |
11 | amended July 27, 1973 (P.L.230, No.60), are amended to read: |
12 | Section 1001. Qualifications of Councilmen.--The councilmen |
13 | shall be at least twenty-one years of age, and shall be elected |
14 | by the electors at large. They shall have been residents of the |
15 | city wherein they shall be elected throughout one year next |
16 | before their election, [and] shall reside therein throughout |
17 | their terms of service and shall be registered to vote in the |
18 | city they are seeking to represent. No officer of the United |
19 | States or of the Commonwealth of Pennsylvania (except notaries |

1 | public or officers of the militia), nor any county officer, nor |
2 | any officer of any school district embraced in the territory of |
3 | said city, nor any officer or employe of said city, or of any |
4 | department thereof, nor any member or employe of a municipality |
5 | authority of which the city is a member, shall serve as a |
6 | councilman during his continuance or employment, except as |
7 | hereinafter provided. |
8 | Section 1201. Qualifications.--The mayor shall be at least |
9 | twenty-one years of age, and shall be elected at large by the |
10 | qualified electors of the city. He shall have been a resident of |
11 | the city wherein he shall be elected for one year, next before |
12 | his election, and shall reside in the city throughout his term |
13 | of service and shall be registered to vote in the city he or she |
14 | is seeking to represent. |
15 | Section 2. Section 1401 of the act, amended July 27, 1973 |
16 | (P.L.229, No.59), is amended to read: |
17 | Section 1401. Qualifications.--The city treasurer shall be a |
18 | competent accountant, at least twenty-one years of age, and |
19 | shall have been a resident of the city for at least one year |
20 | next prior to his election. He shall reside in the city |
21 | throughout his term of office and shall be registered to vote in |
22 | the city he or she is seeking to represent. |
23 | Section 3. Section 1701 of the act, amended July 27, 1973 |
24 | (P.L.234, No.62), is amended to read: |
25 | Section 1701. Qualifications.--The city controller shall be |
26 | a competent accountant, at least twenty-one years of age, shall |
27 | have been a resident of the city for at least one year next |
28 | before his election, and shall reside in the city throughout his |
29 | term of office and shall be registered to vote in the city he or |
30 | she is seeking to represent. |

1 | Section 4. The amendment of sections 1001, 1201, 1401 and |
2 | 1701 of the act shall apply to elections occurring on or after |
3 | the effective date of this section. |
4 | Section 5. This act shall take effect in 60 days. |
