           HOPPER, TILGHMAN, BELL, MADIGAN, SHAFFER, ARMSTRONG,

        SENATOR HESS, EDUCATION, AS AMENDED, JUNE 5, 1989

                                     AN ACT

     1  Making appropriations from the General Fund and the Federal       <--
     2     Alcohol and Drug Abuse and Mental Health Services Block Grant
     3     to the Department of Health for salaries of personnel in the
     4     Student Assistance Program.
     5  AMENDING THE ACT OF MARCH 10, 1949 (P.L.30, NO.14), ENTITLED "AN  <--
     6     ACT RELATING TO THE PUBLIC SCHOOL SYSTEM, INCLUDING CERTAIN
     7     PROVISIONS APPLICABLE AS WELL TO PRIVATE AND PAROCHIAL
     8     SCHOOLS; AMENDING, REVISING, CONSOLIDATING AND CHANGING THE
     9     LAWS RELATING THERETO," PROVIDING ASSISTANCE FOR STUDENTS AT
    10     RISK FOR DRUG AND ALCOHOL ABUSE.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  It is the intent of this act that the State        <--
    14  appropriation when added to the Federal Alcohol and Drug Abuse
    15  and Mental Health Services Block Grant appropriation will amount
    16  to the sum of $400,000 for the payment of salaries of Drug and
    17  Alcohol Education personnel in the Student Assistance Program of
    18  the Department of Education.
    19     Section 2.  The sum of $110,000 is hereby appropriated to the


     1  Department of Health for the fiscal year July 1, 1989, to June
     2  30, 1990, from the General Fund for the payment of salaries of
     3  Drug and Alcohol Education personnel in the Student Assistance
     4  Program of the Department of Education.
     5     Section 3.  The sum of $290,000 is hereby appropriated to the
     6  Department of Health for the fiscal year July 1, 1989, to June
     7  30, 1990, from the Federal Alcohol and Drug Abuse and Mental
     8  Health Services Block Grant for the payment of salaries of Drug
     9  and Alcohol Education personnel in the Student Assistance
    10  Program of the Department of Education.
    11     Section 4.  This act shall take effect July 1, 1989, or
    12  immediately, whichever is later.
    13     SECTION 1.  THE ACT OF MARCH 10, 1949 (P.L.30, NO.14), KNOWN   <--
    14  AS THE PUBLIC SCHOOL CODE OF 1949, IS AMENDED BY ADDING A
    15  SECTION TO READ:
    16     SECTION 1547.1.  STUDENT ASSISTANCE PROGRAM.--(A)  EACH
    17  SCHOOL DISTRICT SHALL PROVIDE A STUDENT ASSISTANCE PROGRAM FOR
    18  THE IDENTIFICATION AND REFERRAL OF STUDENTS AT RISK FOR DRUG AND
    19  ALCOHOL USE AND ABUSE.
    20     (B)  THE DEPARTMENT OF EDUCATION SHALL CONSULT WITH THE
    21  DEPARTMENT OF HEALTH, OFFICE OF DRUG AND ALCOHOL PROGRAMS, IN
    22  DEVELOPING THE INSTRUCTIONAL MATERIALS UTILIZED TO TRAIN STUDENT
    23  ASSISTANCE PROGRAM PERSONNEL AND TO QUALIFY THE TRAINEES.
    24     (C)  SCHOOL DISTRICTS MAY USE THE SERVICES OF THE DEPARTMENT
    25  OF EDUCATION FOR THE REQUIRED TRAINING OR CONTRACT WITH A
    26  PRIVATE PROVIDER APPROVED BY THE DEPARTMENT OF HEALTH, OFFICE OF
    27  DRUG AND ALCOHOL PROGRAMS. IF THE SCHOOL DISTRICT CONTRACTS WITH
    28  A PRIVATE PROVIDER, THE DEPARTMENT OF EDUCATION SHALL MAKE THE
    29  INSTRUCTIONAL MATERIALS AVAILABLE TO THE SCHOOL DISTRICT.
    30     (D)  IN DEVELOPING ITS STUDENT ASSISTANCE PROGRAM, EACH

     1  SCHOOL DISTRICT SHALL CONSULT WITH THE SINGLE COUNTY AUTHORITY
     2  DESIGNATED BY THE DEPARTMENT OF HEALTH TO PROVIDE DRUG AND
     3  ALCOHOL SERVICES IN THE SCHOOL DISTRICT'S AREA.
     4     SECTION 2.  THIS ACT SHALL TAKE EFFECT IN 60 DAYS.
