AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," further providing for manner of
6election or approval and for term and salary of assistants.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Sections 1073(b) and 1077(b) of the act of March
1010, 1949 (P.L.30, No.14), known as the Public School Code of
111949, amended July 12, 2012 (P.L.1142, No.141), are amended to
12read:

13Section 1073. Manner of Election or Approval.--* * *

14(b) At a [regular] public meeting of the board of school
15directors occurring at least [one hundred fifty (150)] ninety 
16(90) days prior to the expiration date of the term of office of
17the district superintendent, the agenda shall include an item
18requiring affirmative action by five or more members of the
19board of school directors to notify the district superintendent
20that the board intends to retain him for a further term of three

1(3) to five (5) years or that another or other candidates will
2be considered for the office. In the event that the board fails
3to take such action at a [regular] public meeting of the board
4of school directors occurring at least [one hundred fifty (150)]
5ninety (90) days prior to the expiration date of the term of
6office of the district superintendent, [he shall continue in
7office for a further term of similar length to that] the term of 
8office which he is currently serving[.] shall be extended for 
9one (1) year. Such notification shall not prevent the 
10superintendent from being considered for or appointed to a 
11further term of office notwithstanding the consideration of 
12other candidates.

14Section 1077. Term and Salary of Assistants.--* * *

15(b) At a [regular] public meeting of the board of school
16directors occurring at least [one hundred fifty (150)] ninety 
17(90) days prior to the expiration date of the term of office of
18the assistant district superintendent, the agenda shall include
19an item requiring affirmative action by five (5) or more members
20of the board of school directors to notify the assistant
21district superintendent that the board intends to retain him for
22a further term extending through the term of the school district 
23superintendent or of three (3) to five (5) years or instead that
24another or other candidates will be considered for the office.
25In the event that the board fails to take such action at a
26[regular] public meeting of the board of school directors
27occurring at least [one hundred fifty (150)] ninety (90) days
28prior to the expiration date of the term of office of the
29assistant district superintendent, [he shall continue in office
30for a further term of similar length to that] the term of office

1which he is currently serving[.] shall be extended for one (1) 
2year. Such notification shall not prevent the assistant district 
3superintendent from being considered for or appointed to a 
4further term of office notwithstanding the consideration of 
5other candidates.

6Section 2. This act shall take effect in 60 days.
