AN ACT 1 Establishing a pilot program to provide for automated 2 enforcement of meeting or overtaking school bus requirements 3 in a selected school district; and making an appropriation. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Short title. 7 This act shall be known and may be cited as the Automated 8 Enforcement System on School Buses Pilot Program Act. 9 Section 2. Definitions. 10 The following words and phrases when used in this act shall 11 have the meanings given to them in this section unless the 12 context clearly indicates otherwise: 13 "Department." The Department of Transportation of the 14 Commonwealth. 15 "Program." The Automated Enforcement System on School Buses 16 Pilot Program established in section 3. 17 Section 3. Automated Enforcement System on School Buses Pilot 18 Program.
1 (a) Nature of program.--The department is authorized to 2 establish and administer the Automated Enforcement System on 3 School Buses Pilot Program during the 2007-2008 school year. The 4 program shall provide for the enforcement of 75 Pa.C.S. § 3345 5 (relating to meeting or overtaking school bus) by recording 6 violations using an automated enforcement system designed to be 7 installed on school buses and approved by the department. 8 (b) Duties of department.--The department shall: 9 (1) Develop and publicize an application procedure for 10 school districts interested in participating in the program. 11 (2) Select one school district to participate in the 12 program from the list of applicant school districts. 13 (3) Make available a one-time grant to the school 14 district selected to fund the implementation and operation of 15 the automated enforcement system under this act in the 2007- 16 2008 school year. The grant may not exceed $100,000 or be 17 derived from the Motor License Fund. 18 (4) Monitor and evaluate the program and present a 19 report of the evaluation to the Transportation Committee of 20 the Senate and the Transportation Committee of the House of 21 Representatives. 22 Section 4. Appropriation. 23 The sum of $100,000 is hereby appropriated to the Department 24 of Transportation for the fiscal year July 1, 2007, to June 30, 25 2008, for the purposes of administering this act. 26 Section 5. Expiration. 27 This act shall expire June 30, 2008. 28 Section 6. Effective date. 29 This act shall take effect immediately. A30L75DMS/20070S0686B0775 - 2 -
