SENATE BILL

                                     AN ACT

     1  Amending the act of December 15, 1980 (P.L.1203, No.222),
     2     entitled "An act providing for the regulation for energy
     3     conservation purposes of the construction of buildings, the
     4     establishment of a Building Energy Conservation Committee and
     5     a Board on Variances, appeals and for penalties," requiring
     6     municipalities to exercise administrative and enforcement
     7     procedures, including prior plan approval, building permit
     8     requirements, use or occupancy permit requirements and
     9     inspections during the course of construction.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Section 503 of the act of December 15, 1980
    13  (P.L.1203, No.222), known as the Building Energy Conservation
    14  Act, is amended to read:
    15  Section 503.  Powers of municipalities.
    16     Any municipality electing to administer the provisions of
    17  this act under section 501 or 502 shall exercise the same powers
    18  conferred upon the department by this act, including the power
    19  to institute proceedings for violations of the act, with the
    20  exception of those powers specified in sections 301, 303 and in
    21  Chapter 4. In addition, any such municipality [may] shall


     1  exercise such other administrative and enforcement procedures as
     2  it shall deem necessary to effect the purposes of this act
     3  including, but not limited to, prior plan approval, building
     4  permit requirements, use or occupancy permit requirements and
     5  inspections during the course of construction.
     6     Section 2.  This act shall take effect in 60 days.
