                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for grading for the
     3     use of tobacco in schools.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6306.1(b) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding a subsection to read:
     9  § 6306.1.  Use of tobacco in schools prohibited.

    11     (b)  Grading.--A pupil who commits an offense under this
    12  section shall be subject to prosecution initiated by the local
    13  school district and shall, upon conviction, be sentenced to pay
    14  a fine of not more than $50 for the benefit of the school
    15  district [in which such offending pupil resides] which initiated
    16  the prosecution and to pay court costs. When a pupil is charged
    17  with violating subsection (a), the court may admit the offender
    18  to an adjudication alternative as authorized under 42 Pa.C.S. §

     1  1520 (relating to adjudication alternative program) in lieu of
     2  imposing the fine.
     3     (b.1)  Enforcement.--The joint board, board of directors or
     4  school board shall designate, by resolution, who is authorized
     5  to enforce this section.
