AN ACT 1 Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An 2 act concerning townships of the second class; and amending, 3 revising, consolidating, and changing the law relating 4 thereto," authorizing the establishment of a real estate 5 registry. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Article XII of the act of May 1, 1933 (P.L.103, 9 No.69), known as The Second Class Township Code, reenacted and 10 amended November 9, 1995 (P.L.350, No.60), is amended by adding 11 sections to read: 12 Section 1204. Provisions for Registration of Real Estate.-- 13 For the purpose of procuring accurate information in reference 14 to the ownership of all real estate, the township supervisors 15 may provide by ordinance for a registry of all real estate. 16 Section 1205. Preparation of Books, Plans and Maps.--The 17 township engineer of any township in which a registry shall be 18 established shall cause to be made all necessary books, maps and 19 plans as will show the situation and dimensions of each property
1 in the township. The books, maps or plans shall be prepared so 2 as to show the house number, if any, the name of the owner or 3 owners and shall contain blank spaces for the owner of each lot, 4 with provision for the names of future owners, and dates of 5 future transfer of title. For the purpose of preparing the 6 books, maps and plans, the township engineer shall have free 7 access, without charge, to any of the public records where the 8 necessary information may be obtained. The township engineer may 9 also cause a search to be made in any other place for any 10 muniments or evidence of title not reported to the township 11 engineer and required for completion of the books, maps or 12 plans. 13 Section 1206. Preservation of Records.--The books, maps and 14 plans shall be carefully preserved in the office of the engineer 15 of the township. The books, maps and records shall be kept, by 16 additions from time to time, or otherwise, so as to show the 17 ownership of every lot or piece of real estate, or subdivision 18 of a lot or piece of real estate, within the township limits, 19 with the successive transfers of title, from the date of the 20 commencement of the plans. Nothing in the books, maps or records 21 or in this article shall invalidate any municipal or tax claim 22 by reason of the fact that the claim is not assessed or levied 23 against the registered owner. 24 Section 2.
