                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for payments on
     6     account of transportation of nonpublic school pupils.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 2509.3 of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949,
    11  amended June 30, 1995 (P.L.220, No.26), is amended to read:
    12     Section 2509.3.  Payments on Account of Transportation of
    13  Nonpublic School Pupils.--(a)  Each school district, regardless
    14  of classification, shall be paid by the Commonwealth the sum of
    15  thirty-five dollars ($35) for each nonpublic school pupil
    16  transported in the school year 1978-1979 through the school year
    17  1983-1984. For the school year 1984-1985 through the school year
    18  1989-1990, each school district shall be paid the sum of seventy
    19  dollars ($70) for each nonpublic school pupil transported. For


     1  the school years 1990-1991 and 1991-1992, each school district
     2  shall be paid the sum of one hundred twenty-four dollars ($124)
     3  for each nonpublic school pupil transported. For the school year
     4  1992-1993 and the 1993-1994 school year, each school district
     5  shall be paid the sum of one hundred fifty-nine dollars ($159)
     6  for each nonpublic school pupil transported. For the school year
     7  1994-1995 [and each] through the school year [thereafter] 1996-
     8  1997, each school district shall be paid the sum of two hundred
     9  dollars ($200) for each nonpublic school pupil transported.
    10     (b)  For the school year 1997-1998, and each school year
    11  thereafter, each school district, regardless of classification,
    12  shall be paid for the costs to the school district for the
    13  transportation of pupils attending nonpublic school as required
    14  by section 1361. Costs of the transportation shall be the actual
    15  costs as certified by the district for the transportation of
    16  pupils attending nonpublic schools in excess of the costs which
    17  would be borne by the school district if such pupils were
    18  attending the public schools of the school district. The
    19  Secretary of Education shall promulgate guidelines necessary to
    20  assist in the implementation of this subsection.
    21     Section 2.  This act shall take effect July 1, 1998, or
    22  immediately, whichever is later.
