SENATE BILL

        INTRODUCED BY MELLOW, MUSTO, WILLIAMS, KASUNIC, COSTA AND
           PICCOLA, APRIL 2, 1997

        AS AMENDED ON THIRD CONSIDERATION, JUNE 16, 1997

                                     AN ACT

     1  Authorizing cities of the second class A to impose property
     2     maintenance ordinances.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Property maintenance ordinance.
     6     (a)  Imposition; penalties.--A city of the second class A may
     7  impose property maintenance ordinances and any standard or
     8  nationally recognized property maintenance code. The property
     9  maintenance ordinance may provide penalties of fines not
    10  exceeding one per month on a property and limited to no more
    11  than $1,000 for the first two continual and uncorrected
    12  violations of the same subsection of such ordinance on the same
    13  property and not exceeding $10,000 $5,000 for the third and any   <--
    14  subsequent continual and uncorrected violation of the same
    15  subsection of such ordinance on the same property.
    16     (b)  Graded penalties.--If a violation of the property
    17  maintenance ordinance is found to pose a threat to the public's


     1  health, safety or property, then penalties of fine may be
     2  provided for as follows:
     3         (1)  Not exceeding one violation CITATION per five         <--
     4     calendar days for a continual and uncorrected violation of
     5     the same subsection of such ordinance on the same property.
     6         (2)  Limited to no less than $500 and no more than $1,000
     7     for the first two continual and uncorrected violations of the
     8     same subsection of such ordinance on the same property and no
     9     less than $1,000 and not exceeding $10,000 for the third and
    10     any subsequent continual and uncorrected violation of the
    11     same subsection of such ordinance on the same property, or
    12     imprisonment for any term not exceeding 90 days, or both.
    13  Section 2.  Effective date.
    14     This act shall take effect in 60 days.
