                                     AN ACT

     1  Amending Title 23 (Domestic Relations) of the Pennsylvania
     2     Consolidated Statutes, providing for periodic review of
     3     support orders.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4352(a) of Title 23 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding a subsection to read:
     9  § 4352.  Continuing jurisdiction over support orders.
    10     (a)  General rule.--The court making an order of support
    11  shall at all times maintain jurisdiction of the matter for the
    12  purpose of enforcement of the order and for the purpose of
    13  increasing, decreasing, modifying or rescinding the order
    14  without limiting the right of the obligee to institute
    15  additional proceedings for support in any county in which the
    16  obligor resides or in which property of the obligor is situated.
    17  A system shall be developed for the automatic review of each
    18  order of support at least once every three years, from the date

     1  of establishment or the most recent review, for the purpose of
     2  making any appropriate increase, decrease, modification or
     3  rescission of the order. If, however, it is determined that such
     4  a review would not be in the best interests of the child and
     5  neither parent has requested a review in the interim, no review
     6  shall be required.
     7     (a.1)  Notice.--Each parent subject to a child support order
     8  shall be notified, 30 days in advance of the commencement of
     9  such a review, of the right of the parent to request a review of
    10  the order and of any proposed adjustment, or determination that
    11  there should be no change, in the order. A parent shall have 30
    12  days from the date of the notice to initiate a challenge to the
    13  adjustment or determination.
