AN ACT
1 Amending Titles 24 (Education) and 71 (State Government) of the
2 Pennsylvania Consolidated Statutes, further defining
3 "effective date of retirement."
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. The definition of "effective date of retirement"
7 in section 8102 of Title 24 of the Pennsylvania Consolidated
8 Statutes is amended to read:
9 § 8102. Definitions.
10 The following words and phrases when used in this part shall
11 have, unless the context clearly indicates otherwise, the
12 meanings given to them in this section:

14 "Effective date of retirement." The first day following the
15 date of termination of service of a member if he has properly
16 filed an application for an annuity within 90 days of such date
17 or:
18 (1) In the case of a member who applies for an annuity
1 subsequent to 90 days after termination of service, the date
2 of filing such application or the date specified on the
3 application, whichever is later.
4 (2) In the case of a vestee who files an application for
5 an annuity within 90 days of his superannuation age, the
6 attainment of such age.
7 (3) In the case of a vestee who defers the filing of an
8 application for an annuity to a date later than 90 days
9 following attainment of superannuation age, the date of
10 filing or the date specified on the application, whichever is
11 later.
12 (4) In the case of a finding of disability, the date
13 certified by the board as the effective date of disability.
14 (5) In the case of the supplemental annuity provided for
15 under section 8348.5 (relating to supplemental annuities
16 commencing 1998), the most recent date of termination of
17 service of a member.

19 Section 2. The definition of "effective date of retirement"
20 in section 5102 of Title 71 is amended to read:
21 § 5102. Definitions.
22 The following words and phrases as used in this part, unless
23 a different meaning is plainly required by the context, shall
24 have the following meanings:

26 "Effective date of retirement." The first day following the
27 date of termination of service of a member if he has properly
28 filed an application for an annuity within 90 days of such
29 date[; in] or:
30 (1) In the case of a vestee or a member who does not

1 apply for an annuity within 90 days after termination of
2 service, the date of filing an application for an annuity or
3 the date specified on the application, whichever is later.
4 (2) In the case of a finding of disability, the date
5 certified by the board as the effective date of disability.
6 (3) In the case of the supplemental annuity provided for
7 under section 5708.5 (relating to supplemental annuities
8 commencing 1998), the most recent date of termination of
9 service of a member.

11 Section 3. The amendment of 24 Pa.C.S. § 8102 and 71 Pa.C.S.
12 § 5102 shall apply retroactively to the first monthly annuity
13 payment after July 1, 1998, and each monthly annuity payment
14 thereafter as provided in 24 Pa.C.S. § 8348.5 and 71 Pa.C.S. §
15 5708.5.
16 Section 4. This act shall take effect immediately.
