AN ACT

 

1Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as
2reenacted and amended, "An act concerning townships of the
3second class; and amending, revising, consolidating and
4changing the law relating thereto," further providing for
5township manager, appointment, removal, powers and duties,
6compensation and bond; and providing for evasion of
7requirements.

8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:

10Section 1. Section 1301 of the act of May 1, 1933 (P.L.103,
11No.69), known as The Second Class Township Code, reenacted and
12amended November 9, 1995 (P.L.350, No.60), is amended by adding
13a subsection to read:

14Section 1301. Township Manager; Appointment, Removal, Powers
15and Duties; Compensation; Bond.--* * *

16(d) No individual shall be appointed to the office of
17township manager in the township in which he was elected to
18serve as township supervisor until ninety days after the date he
19left the office, whether by expiration of a term, resignation or
20for any other reason.

21Section 2. The act is amended by adding a section to read:

1Section 1302. Evasion of Requirements.--No supervisor shall
2vote to evade the requirements of this article by appointing or
3employing a person in a capacity substantially similar to that
4of the township manager except as provided in section 1301.

5Section 3. This act shall take effect immediately.
